1. Acceptance of Terms

By accessing and using Cardabrate ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Legal Entity

Cardabrate is a product operated by The A Dynasty LLC, a Wyoming limited liability company. Payments, invoicing, and tax compliance for the Service are handled by our Merchant of Record, Paddle.com.

3. Description of Service

Cardabrate provides automated customer engagement services, including but not limited to:

• Automated greeting card scheduling and delivery
• Customer relationship management features
• Event tracking and reminders (birthdays, anniversaries, etc.)
• Analytics and reporting tools

4. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription Plans and Billing

5.1 Plan Types

We offer the following subscription plans:

• Free Plan: Limited features for up to 25 customers
• Pro Plan: Full features for up to 1,000 customers at $29/month or $290/year

5.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment processing, invoicing, and tax handling are provided by our Merchant of Record, Paddle.com. Paddle is the legal seller of record for all transactions and will appear on your billing statements
• You authorize us to charge your payment method for all fees

5.3 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• You will retain access to paid features until the end of your billing period
• No refunds are provided for partial billing periods

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Send unsolicited or spam communications through the Service
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights of others
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service or related systems
• Use the Service to harass, abuse, or harm another person
• Impersonate any person or entity

You are responsible for ensuring that all recipients have provided appropriate consent to receive communications in accordance with applicable email and anti-spam laws.

7. Content and Data

7.1 Your Content

You retain all rights to the content and customer data you submit to the Service. By submitting content, you grant us a license to use, store, and process your content solely to provide the Service to you.

7.2 Our Content

The Service and its original content, features, and functionality are owned by Cardabrate and are protected by international copyright, trademark, and other intellectual property laws.

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our collection and use of information in accordance with our Privacy Policy.

9. Service Availability

• We strive to provide reliable service but do not guarantee uninterrupted access
• We may modify, suspend, or discontinue the Service at any time
• We are not liable for service interruptions or data loss except as required by applicable law
• Scheduled maintenance will be communicated in advance when possible

10. Limitation of Liability

To the maximum extent permitted by law, Cardabrate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or the like that may be transmitted to or through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

11. Refund Policy

Due to the nature of our subscription-based service, refunds are generally not provided for partial billing periods or unused services. For complete details, please see our Refund Policy.

If you believe a charge was made in error or you experience a technical issue that prevents use of the Service, you must contact us within 7 days of the charge. Refunds, if granted, are issued at the discretion of Paddle in accordance with their policies.

12. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. You are advised to review these Terms periodically for any changes. Your continued use of the Service after any modifications indicates your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
